
A Family Law Reform is needed now
Family court laws and Child Support laws are in desperate need of reform. The current systems are based off of a time long passed, where the father was the main source of income and the mother was home to nurture. In today's time it takes both parents working a full time job to support a family. That being said the family court system is being highly abused.
The current system is gender biased and does not have the child's best interest. With the current system in place it financially encourages women to prevent the fathers from visitation or even speaking with the children. This is called parental alienation and is a form of child abuse.
Alienating behaviors, often found in high-conflict divorce and custody situations, can cause mental and emotional anguish to children, depriving them of their right to love and be loved by both parents. Parental alienation takes advantage of the suggestibility and dependency of children and deprives them of their right to love and be loved by both parents. Parental alienation is considered harmful to children, robbing them of their sense of security, and can affect them into adulthood with tragic consequences.
The mother of the children can make enough from child support to be comparable to a full time job. This encourages them to do less for themselves. This also allows them to collect SNAP benefits, and other state benefits, which puts a strain on the welfare system that child support was initially ment to supplement.
To correct these issues a rebuttable presumption of 50/50 custody and stricter stipulations for child support should be put into effect. Child support should not be granted to either party unless the one of the parents are absent from the child's life. If both parents are attempting to be a part of the child's life there should be no reason for child support.
Child support is ment to aid in the support of the child. Not a means for the mother to live off of without having a job themselves. Child support should not exceed the cost of a mortgage or rent for the month. It does not cost over $1000 a month to support a child. There should be a cap on the amount of support that is paid if deemed necessary, and it should be only used for support of the child not support of the mother.
