DHS is going to publish a rule Extending Employment Authorizations to Spouses of Certain H-1B Workers. This will give work permits to 97,000 foreign nationals (mostly indians). Originally, the bill written by the Gang of Eight, only gave that authority to the Secretary if the home country of the foreign national did the same for U.S. workers. The Gang of Eight?s bill said, ?The Secretary of Homeland Security shall authorize the alien spouse to engage in employment in the United States only if such spouse is a national of a foreign country that permits reciprocal employment.? Currently India does not allow spouses of US citizens to work in their country. The intent of the authors of the Senate bill was to ensure that American spouses were treated equally. The rule does not take this into consideration. DHS should consider the option and It will reduce the eligible beneficiaries to a great extent. -

Completely disagree with the reasoning. H4 EAD must be passed. There is so much talent that is being unused, not just the frustration of H4 holders. My wife is highly capable and qualified. I have seen many fakers on other visas too. Hiring process is independent of visa. H4 EAD for all :)REPORT COMMENTS

The primary H1B should probably have STEM degree and should lived in US for significant amount of time before his/her spouse should become eligible for this benefit. It is only logical. My wife has 4+ years of IT experience working in different countries. Based on her experience and skills she got job in just couple of weeks when she was on dependent work visa in other country. But now as she is on H4 she cannot work even though there are suitable jobs matching her profile. Please do not pass H4 EAD rule. Unless government have a strict system of filtering eligible candidates, this will be of no use. There should be a strong way to do a background check with real and genuine experience if this rule is passed. There should also be stringent rules in allotting the EAD visas, for ex The H4 EAD eligible people should be working only where the primary dependent is working and the primary dependent should complete his/her 6 years on H1b with I-140 approved.REPORT COMMENTS

My husband is here since 2003 August. Has a US master degree, no Green Card yet, living on approved I140. I am on H4 visa from last 5 years. I have Master's degree in Biology. I am very interested to work but due to my visa status I am not able to work. From childhood I had a dream to work and become an independent person. I want to gain self confidence and be self dependent. USA is a land of opportunities but for the H4 holders all the doors are closed. I have a advance degree and I want to contribute to this nation. I agree with what this person initally said about fake resume and all. I have seen it happening around me all the time. This could have happened to me, but i was confident that after having so many years of exp why do I need to fake my exp. But this is happening because vendor tell people that US experience is required to get a job in IT. Which is ridicoulus. I had 6 yrs of exp out of US and I am skilled professinal, still they suggest you to portray 11 yrs of exp or so. This wrong notion of exp in a certain country is wrong. What company should ask for is actual exp and if you can perform good in Interviews. Anyways, H4 EAD has nothing to do with fakeness, its all about how well the company verifies the background. H4 EAD will allow people to work as per their skillset and not waste their time waiting fro GC EAD to come and then work. I also think, people in GC queues who have reached till a certain approval level should be allowed to get EAD for H4 spouse. Also, couple of my friends are in Medical and Education and MBA and other Engineering fields.....But in USA only thing that works is IT :) funny they all tried their luck in their domain and only watsed time. Now everyone who gets married and their wives come here they stright try in IT if they are on L2 EAD or get enrolled in MS and within 2 yrs get OPT and start working and get H1 done. So, ultimatlly what worked here in ONLY IT......all other professions are ignored here. thats the reason IT is getting messsed. Make other processes strong and nice instead of stopping people to work. That is the reason that H! quota is always full now and we have a lottery system as everyone who worked on L2 EAD is filing for their won H1B instead of staying home on H4. I am with the agreement that H4 people should also be given EAD. If not all then May be base don Number of years spent in USA.REPORT COMMENTS

Like all of the H1B holders, i am also awaiting for H4 EAD for my architect wife. If everyone who has approved I-140 gets H4 EAD, than is it fair for the guys who had been waiting over 6 years of H1B term on approved I-140??. People use all loopholes if available, EB2 was flooded when H1B people without advanced degrees used the loophole of experience. Now EB2 is pushed way way back. Never ending story.REPORT COMMENTS

I have done my Masters in Biological Science and I do not want to work in IT industry for any cost and even if your IT Contracting industry offers me USD 10K per month then what do you say?
