I would like to have this rule passed. This is not only related to IT. All the h4 dependents are looking for IT job. My wife is a nurse and passed all her required equivalent examinations here in the united states and hold a state license for Nurse for more than 2 years. I am desperately waiting for getting EAD. Being in H4 for 8 years now, my kids are in college, we are paying international fees, there is a limit to patience. There are so many women like me in their 40s and getting into 50s who have been waiting for so long. Everyone needs financial security for themselves, one cannot rely on children as well as husbands these days. We gave up our career to keep the family intact & moved to US, with no secure future, ended jobless here. The government should at least give EAD to the women who are in their 40s & 50s first considering their age and need for financial security, what is the use of getting to work when you have lost all the confidence and strength to work??REPORT COMMENTS

I agree with some of the commenters here. If L2 spouses can get EADs and work in any field, irrespective of what their undergrad/grad degrees are, why is everyone jumping at a chance to curb such an opportunity for H4 holders? It is very sad that a commenter says, "even H4." This only goes to show how far below on the food chain we are, irrespective of the fact that most of us hold advanced degrees in science. Opinions should be based on clear understanding of a subject, not just hypothesis. To put down an entire community of people, many of whom are eagerly awaiting a legal, albeit very very late opportunity to work is done in very bad taste. I do not agree with the fact the EADs are being misused. Even if people are faking resumes to get into contracting positions , they would definitively have a clear a good amount of interviews to actually bag those positions . Just holding an EAD or green card or even being a citizen with a fake resume can never land a job . I am sure even companies planning to hire new employees would know of this situation and take necessary steps to filter out the people with fake resumes. Though the point mentioned in this looks very conviencing. Don't we think we are questioning the companies who are giving them employement ? do you think they will hire someone because he/she has EAD. I do not think so. I have seen people stugling to get job even on GC. I believe the hiring companies knows what they are hiring and if they are not capable of doing then their is very much chances that they will end up hiring wrong person who is a "Citizen, has GC, has H1, L1 etc." I donot think this is valid reason not to grant EAD. I think it is very necessary for h4 spouses to get EAD especially after investing so much time of life in US. I have completed 6 years of h1b. It's been almost 4 years that my wife is on h4 who can not work due to the restrictions. She is highly qualified engineer with work experience in the past. I am sure that given a chance, she will do her best to contribute to US economy and development in the country. If current situation continues, I who worked with multiple start up companies and helped them grow bigger will move to a different country where my and wife's talent will be given respect and chance to thrive. The promoters of this petition either do not understand how EAD, or generally how IT industry works, or are deliberately trying to send wrong message for their own purpose. For one thing, EAD can not be used as a tool to create fake resumes. Most employees hire professional background checking companies to check candidate's backgrounds including education, working experience etc, these checks are based on facts gathered from government institutions, former employees and 3rd party investigation agencies, EAD can not be considered as proof of the candidate's ability to fulfill certain job requirements. Secondly, for employers that do not or can not afford to perform detailed background checks, don't forget the candidates still need to go through the interview process, whether a candidate has 8 years of experience or not can be easily told during the interview. The idea about having someone else to take the interview for an candidate is ridiculous, what would a manager do if one finds out the one comes to work is different from the one he/she has interviewed? I can't think of any action other than firing the worker immediately. The arguments about the H4 EAD petition would create an unfair competitive advantage for H4 visa holders is simply not true. Furthermore, the US IT industry is NOT suffering heavily because of EADs granted to J2, L2 and H4 dependents. The US IT industry is suffering heavily from not having enough skilled workers. That is precisely the reason big IT corporations like facebook are promoting STEM immigration reforms - to be able to recruit more workers. This petition helps that purpose instead of hurt it. It does that by reinforcing the IT workforce (despite its rather small scale), and creating a better chance for talented IT works whom holds J2/L2/H4 visas to stay in the US. The argument about H4 EAD hurts IT industry is not true. The petition does make one thing correct - which is the IT industry is highly competitive and there are many good job seekers out there. However, this should not be used as an excuse to create a artificial barrier for more workers to enter this area. Competition makes a industry better not worse as long as its fair.There is no proof the H4 EAD would make the competition less fair, quite contrary, forbidding a certain group of people whom live in the US legitimately to participate in the competition - which is the current situation - is unfair, that is precisely the reason we should pass the H4 EAD bill - to create a more fair playground so the industry would benefit. Last not least, the argument about H4 visa holders do not hold US STEM degrees so should not be granted EAD is wrong. A simple fact is a H4 visa holder can also hold a US STEM degree - and the US STEM degree is of course considered during the hiring process of any IT company. While above concern expressed is not just limited to H4 EAD or any such EAD(L2,J2), it is also true for work visas. Fake resumes are created who are on H1B or other work visas too. By limiting a particular visa or EAD does not stop this illegal practice. An employer / Recruiter should do a thorough background check before filling a position or during interview process. Once found guilty of malpractice, respective candidate should be marked for black list. Many genuine qualified legitimate H1B holders are being impacted due to this malpractice. It needs to be curbed. Anyhow, coming back to the actual discussion of H4 EAD, with the current open IT positions which are left unfilled and hard to find resources, H4 EAD will definitely help the economy and also other unfilled positions in other job fields ( not necessarily IT ). H4 EAD should be soon implemented. Adding to this, there should be strict review process on granting H4 EAD and other existing EADs (L2/J2) to verify their degrees and work experiences. Also, do more audits on the big IT services companies like TCS,Infosys, Wipro, HCL, Accenture etc... if they are misusing the current visa program to ensure right salaries are payed as per LCA. There is a practice where these big IT companies make their employees work on various high salaried roles under wrong LCA ( low salaried roles). Also, getting more L1A visas for their employees and also processing PERM( Green card) on EB1 category. There should be a stringent check on this and regular, frequent audits need to be conducted. Though H4 EAD is independent to the Frauds/illegal hiring practices, only qualified H4 dependents should be provided with EADs and not to every other H4 individual. I oppose this strongly. Most of H4 holders don't have IT background nor they are interested in IT jobs but they are talented to work in other areas and had career before they moved to US. My wife is a mechanical engineer and was working in the R&D in world's top mechanical company. After coming here, it was hard to get the job in the companies in the mechanical field. first question used to be, do you have work visa? STEM is not only IT. Now the argument of this impacting IT jobs. It is hard to find engineers in the bay area. Ask recruiters. Many companies are opening new centers in other areas and countries because they don't have man power available. and companies are not fool. you can get a job with fake resume but that doesn't make you qualified to do the job. sooner or later you will be caught. and most importantly H4 restriction is against humanity. why force someone to sit at home just because they don't have IT background. why somebody should get another degree when they already have one. if they are not qualified enough, they will not get the job and pursue higher education. many H4 holders want to start their own business which will support the job creation. fake resume and IT jobs are irreverent to H4 EAD.REPORT COMMENTS

The fake resume business as described is all too prevalent, and several people I know have successful careers building upon fake resumes. I don't know though whether this is illegal or just unethical. Maybe that is why there is not much punitive action against this practice. I think at least the consulting/body shopping companies that either encourage or knowingly participate in this are breaking some laws. More strict enforcement against them might help.
