No one understands the harm with H4 EAD allowed to work whereever they want. They are ready to work for 10 or 20 dollar for highly skilled work as there is no current process to verify their eligibility for doing a skilled job or they don't need to go through any labour verifications or petition approvals like an H1B holder does. They are a big threat to the whole IT market. There are many people who offer courses for H4 EAD to get trained in software jobs. H4 EAd holders just want to start working, Everyone knows getting a low rate is far better than sitting at home. What we are missing here is making sure only genuine H4 EAD candidates are getting the qualified job which is really a big miss in present condition. -

Wish a new set of strict rules for H4 EAD should be made as soon as possible which tightens who is eligible for this option and what kind of work can they do. If they work in skilled IT related fields where a computer related education needed, additional paper works needs to be submitted which shows their educational evaluations and previous work experiences before they start working.Why don't we have something like this for H4 EAD and the rules are getting tighter for H1B? I really wish H4 EAD's should be scrutnized. Most of them are working in IT fields getting some kind of training in IT related jobs and show all the fake experiences and working. The situation for H4 EAD holders now is they can go anywhere and work. What's happening with that is they are applying in IT fields where skilled people are needed. There are many H4 EAD people who don't have a bachelors degree or masters degree in computers but working in IT as a developer or QA or system admins. No one is scrutnizing their previous experience or education if that;s matching with the job they are doing as H4 EAD is just direct approval wiht out any paperworks related to the work they are doing. This is a big loop hole that many people are taking advantage of. There are genuine people also who works in H4 EAD. SO instead of removing this strict rules should be made if they are working in IT fields. Previous IT related experience and related education should be made mandatory when some one apply for EAD in H4, they need to submit the educational certificates and other documents same as an H1 B holder is doing now. H4 EAD is a big sham and utterly misused by almost 98% of cases. In almost all of these cases the spouses(women) who accompany their husbands on H1B visa have a college degree but no experience in the IT industry(again most of the H4 EAD's are in this area) and float their resumes with atleast 7 years of experience working on multiple projects over that time period. With no way of verifying this work experience and combined with the ease of documentation it offers the middle-men companies compared to H1B and L1 visas this has bloomed in to a practice where fake is the normal. The total effect of this is that the already shrinking job market for the citizens is getting worse with wage depression caused by these fake candidates. These people work for anywhere between $15-30 per hr (any money made is good since they were just twiddling their thumbs until now). The H4 EAD rule should go and not only that the L1 visa are totally abused by the companies these days with the employers(shady ones) applying for permanent residence in EB1 National Interest category thereby depriving the actual candidates who are genuine and have published papers and done some original research. The modus operandi is to make the candidate a Manager who manages teams offshore (International Manager) thereby showing that they add value to the economy or whatever that is. This gives them a clear edge where they bypass the LCA process(Labor certification process) and are fast tracked in to getting their Green cards. There have been many instances where people have got their GC's in 6-8 months while the really deserving people who have filed 10's of years ago are still waiting in the never ending lines.REPORT COMMENTS

I would agree with this to some extend. There are a lot of fake EAD people working in IT field who don't even have 4 year of bachelors degree in Computer science or related computer technology . What the recruiters when hiring them need to make sure they have solid 4 years of bachelors degree in the related field or masters degree and valid prior experience in IT field depending on the need of the job. I wouldn't say to stop H4 EAD, instead of that get the right people in IT field with valid and related education and experience. There are many qualified and well experienced H4 EAD holders. H-1B visa program remains one of the most discriminatory work programs in the U.S. Residents living in Andhra Pradesh, Tamil Nadu and Karnataka have “24 times the chance of being hired as an H-1B as the average resident of the world. Indians are hiring Indians. H1b program is bringing corruption, nepotism and anti-law people to our country. So many visa fraud cases. Firstly, the petitioner does not seem to have a clear understanding regarding the allotment of H4 EAD. The EAD authorization has only been granted to spouses of H1B holders who have been approved for green cards (the US wants to retain these talented individuals so as to remain the #1 country in STEM, other fields) but have not received them due to the broken immigration system (country-wise cap, number of foreign students being admitted every year with no regard to the limited H1B visas or the 8-15year green card queues). This is what the elected representatives need to fix. This petiton and the public comments have several elements that I would like to comment on: 1. Fake experience on resumes for IT jobs: Anyone can put fake experience on a resume from a student on a F1 visa to a US citizen. I have a 2.5 year work gap after I came to the US from my home country but I refused to put fake experience to fill the gap, and still got hired. My company did a background check on me before hiring me. I agree that checks and balances is the answer to cure the cancer, not rescinding it. Companies operate for profit. In the day and age of skype and face to face interviews, I am not sure how direct candidates can fool SMEs or interviewers regarding their experience. Even if somehow they get hired, it is a matter of 1-2 months before incompetencies start showing and one gets fired. Companies are not charities. Why should genuine candidates on H4 EAD be punished for wrong doings of others? The problem is the sweat shops/consultancies that contract candidates to companies by faking experience-these should definitely be banned both for hiring and H1B allotment. Not just H4 EAD holders but everyone authorized to work is suffering because of these outsourcing companies and consultancies. 2. Bias: Rules should be in place for a spouse to not get hired in the same company where a wife/husband is employed. As for race bias, it happens. A white may prefer to hire a white or some whites may prefer to hire people from any race because at the end of the day it is the skillset that matters. I have hired a white despite being from India. Not sure if a rule should be put in place that only whites should be hiring managers..... 3. 2 year STEM degree: On one hand, the US universities want the fees that these non-resident students bring but on the other hand with the restricted number of H1B visas do not want to give an employment opportunity to all or for that matter the most talented ones (visas allotted basis a lottery system). Why should a citizen-in-waiting and their spouse be punished (single income) due to Congress's inability to come to consesus to pass the much needed immigration reform? Why is a 2 year STEM degree a pre-req for employment/EAD? I am highly skilled with great work experience. I have worked with 2 Fortune 50 companies for 9 years in my home country and am currently employed by one here. It is one's talent that matters. 4. No burden on the health care system etc: A H1B and H4 EAD holder are making money, paying taxes, buying houses and cars and are not a burden on the social security systems. Such income earners will drive the US GDP up. 5. Taking away jobs from US citizens: The number of EADs alloted is 0.2% of the working population. Let's assume all H4 EADs are employed - despite that there are currently 6.2 million job openings! What taking away of jobs are we talking about!? Seems like there is a dearth of people who are qualified to do these jobs. 6. Hard work and educating oneself is the answer, not being scared of the competition: The education opportunities are fabulous in the US. Community colleage barely costs anything. Study more technical subjects (don't except a bachelor's degree in liberal arts to land you a $40/hour job), do hard work - school and college are meant for studying not dating or getting drunk. Fearing competition is not the answer-gaining knowledge, experience and hard work is the solution. 7. To be #1 or not: If the US cannot reform immigration laws, then talented individuals will go to countries where they and their spouses are welcome. Today’s is a knowledge-based economy, jobs follow skills & talent. The bigger the talent pool, more opportunities/jobs will be generated not less. For example, which neighborhood would you rather shop for furniture? One with 10 shops or one with 50? Which neighborhood would give you more competitive rates & choices? So, which neighborhood will generate more opportunities/jobs? Furthermore, these H4 EAD guys are in queue for green card and here to stay. They do not collect any gov benefits, will pay taxes & invest in US economy rather than repatriating their income to home country. Now, if H4 EAD is revoked many couples(H1+H4) will relocate to other countries improving their talent pool & competing with America. In other words it is like you have an asset but you purposely don't want to capitalize on it. America needs all the skilled labor available today than ever! Abolish all these programs taking the Americans jobs, there is no shortage of skills, it is all about CHEAP labor and path for immigration. The H1B visa program is being abused by greedy corporations wanting to hire cheap engineering and scientific talent. They know that the Indian and Chinese workers are willing to do anything to get their green card, and due to the long line up, these people are on an H1B on average for 10 years before they get their permanent residency status. Corporations love this because they can essentially work these people to the ground and pay them whatever they want, as these workers have little negotiating power. It is a modern form of slavery. At the same time, it is preventing local engineers and scientists from accessing the High-tech jobs. It is also discouraging the young students growing up in this country from going into the science and engineering fields, as they know the competition is much too fierce. It's a shame. H4 EADs are only issued to H4 holders which the prinicpal, H1B is on its way to getting a green card. In effect, abolishing h4 ead is a temporary fix. Martian W, completely agree with you. These Indian managers are corrupt. It is not favoritism, but corruption. I also have second hand knowledge from one Indian recruiter that one Indian manager told him that he needs 20 resources, and he will hire all 20 from him, but he has to pay money in the bank account, that is with his father-in-laws name in India. I am trying to get more information to report this. This is ridiculous. These corrupt Indian managers, I can't stand them after hearing this. Cancel H4 EAD. All these unaccounted programs eating up American's jobs. There are limited number of jobs. Based on yearly Green Card quota, people are assigned GC and their spouses are already in the job market. Why should we care for GC issue with country quota and foreigners, when American's are having issues with getting jobs. They are biased and corrupt. There is hoard of these H1Bs coming from one country each year, that's why they are not getting the GC. If there is labor shortage, get the people on temporary work visas, don't distribute unaccounted EADs. We should ban all unaccounted visas, be it H1 non-profit/L1 or H4 EAD. All these people on unaccounted work visas are ready to work cheap and bringing down the wages. Also un-skilled H4EADs are creating competition for our High school and college kids. Firstly not all h4 spouse are eligible for EAD. Only the one with approved green card application are eligible. Secondly, canceling H4 ead for all eligible spouses is not fair. Not all h4 ead spouse fake resume and works in IT. There maybe some bad apples, but I am sure people who are not on ead do the same. It's is not a ead issue. Also I don't believe employer will hire someone just by looking at the fake resume. There is a process of interview and selection criteria after resume selection. Please stop h4 ead as per the below comments not all valid h4 ead spouses are eligible to work only just few of them.Since this rule is passes without any restrictions and allowing them to work in any sector they are taking jobs in target to IT companies too.They are coming up with fake experiences and applying for the jobs.earlier when this rule was introduced there are not much eligible people,but now situation is different there are more and more h4 ead's coming directly from thier home country after marriage and taking jobs. They are giving tough competition to other visa holders since they can work for any employer and again no restrictions.This rule should have atleast certaint eligible criteria for jobs.REPORT COMMENTS

Not all H4 spouses are eligible for EAD, only those who are in queue waiting for their green card - receive it. Further, the only reason they are waiting in queue is because there is a per country quota limit for issuing GCs every year. If there had been no quota restrictions these recipients would have already received GC!(i.e. favorable than an EAD). Also many of these spouses are housewife - primarily looking after their children, they would not prefer to work even if they are eligible for EAD. Faking resumes is unethical, if possible it should be penalized, however anyone, a citizen/resident/visa holder can fake resumes. Examining such candidates relies on the hiring organization, you cannot hold the government accountable for it. Unfortunately, a few H1 holders complain about H4 EAD however if their job can be taken by just faking resumes it speaks volumes about their “specialized skills”. If nothing else consider it from a humane perspective, a highly-educated spouse forced to remain unemployed makes her completely dependent, instills a lack of confidence & to some a loss of identity, an EAD alleviates it, but I guess empathy is a rare virtue to come across these days.REPORT COMMENTS

H4-EAD rule itself should be in place which helps families waiting for permanent residency, a chance to start working. It is also a fact that the H4-EAD is being misused in ways (For example: Many applicants are using fake experience and getting into jobs illegally). My opinion is that the H4-EAD should only be given to STEM degree holders and there should be a full background (work experience check) check on job applicant. For that matter, there should be a 'work experience check' for every type of job, be it contracting or full time. In this way EAD will be rightfully useful only to those who are capable. If full past work experience check is mandatory and done in right way, America can reduce legal immigration automaticallly without having to do anything!REPORT COMMENTS

FACTS 1. H4 EAD is not for all H-4 holders. 2. The only people who need it are those who are waiting in line for a green card, but can’t file the I-485 yet. 3. If they were born in a different country, they would have filed the I-485 and would not need an H-4 EAD because they would have a green card and would be able to work anyways. 4. The only thing the H-4 EAD does is move up the timeframe in which some green card applicants can begin working. 5. Anyone getting H-4 EAD is already on the path to become permanent residency and citizenship. 6. If H4 EAD is getting misused, the same is happening with GC and Citizens. Why is the rant only about H4 EAD? The people who are eligible to get H4 EAD are already in the GC queue for over 6 years. It only because they are from India, China or Philippines that they need the H4 EAD, otherwise they would already have been GC holders like the people from other countries, therefore not requiring the H4 EAD. Then why not repeal the work authorization for GC or GC EAD as well? Why should any talent based immigration system care about the country of origin of a person; should it not be based on just "talent"? Which other country has a country of origin based quota for talent based immigration? All other developed countries have a point/score system for talent based immigration. The issue is about people having partial knowledge about the immigration policies. There would not have been a need for H4 EAD if the immigration policy was not broken in the first place. H4 EAD is a temporary patch. Once the immigration policy is fixed right, there wouldn't be a need for H4 EAD as only the talented individuals would be eligible to be in the GC queue thereby eliminating the huge waits (15-20 years in present times) that talented people go through to obtain the GC.REPORT COMMENTS

I hold h4 EAD and I am a physician working in an underserved area.I was eligible for this only after my spouse got green card sponsored through her H1B.The hospital I work for does not "qualify" for h1b because they don't have medical residency or else I would work on H1B.I have 15 years of training and 5 years of experience ,I have worked legally and paid taxes ,SS for around 10 years in the US,this rule gives opportunity to educated talented people to work and support their families.H1b conditions are too stringent and not easy to fulfill in underserved areas.to everyone here who feels h4 EAD is the reason there is unemployment,that's not true.My job supports job of one med assistant ,one nurse and one physician assistant who were hired to help me do my job .For one job on h4 EAD 3 jobs got created ,and that's the fact !REPORT COMMENTS
