Based on the petition, shouldn't the consulting organizations or the individual EAD holders be prosecuted for fraud instead of all the h4 ead holders? A more stringent background check is needed and there is absolutely no basis or facts that prove that all or a majority of h4 EADs are frauds. This is a way too generic statement. H4 EAD only provides an opportunity to work and not a job. Someone from San JOse wrote h4 EAD are ready to work for free. On h4 visa (without EAD) one can actually work for free (volunteer), so actually the problem is worse when EADs are not given to someone who is allowed to be resident of the country but deprived from the right to work.REPORT COMMENTS

I am an H4 EAD holder and currently working as a City Planner for a major City. I came to US in 2009 and completed a masters degree in planning with honors. I also received the outstanding student award from national planning association and honors award for my master thesis ( only one student is given these prizes for all the graduating students in an academic year, so one among around 100). I changed my visa status to international student and got an opportunity to gain practical experience for one year after graduating. During that time I had three part time paid jobs ( internship with two cities and a consulting position with a private organization). Despite having multiple jobs, I couldn't find a h 1 b sponsor as this is not generally done in the planning field. I had to leave the work after the practical training period expired. Fortunately, the h4 EAD rule came in effect in 2015 and I got three full time jobs (two permanent positions with city departments and one private organization). In my current job, I was picked from over 150 applicants. If the petitioner says all H4 visa holders are frauds that is incorrect as I went through an extremely stringent background check process for the government agency and I have worked hard for over 5-6 years to get where I am today. Fake resumes is a genetic problem and I think it's unfair and illogical to punish a small group for that. I have been a legal resident of this country since 2009 and we have cleared our green card labor stage in 2011. H4 EAD only gives a much deserved opportunity to work for spouses of individual who have invested in this country, payed taxes, Social security for a long period of Tim and are on their path to become green card holders. Yes I married an H1b , but I married a person not a visa. At the time I came to this country, people usually used to get green cards on employment basis within 5-6 years while the wait has now stretched to 10-15 years. H4 EAD card holders make less than .01 percent of population above 16 years. If someone is threatened by them, they should first concentrate on competing with the rest of 99.9 percent. Moreover H4 EAD directly serve American citizens. I have a son who is an American citizen by birth and is on autism spectrum. My insurance through the employer covers his therapies and I have hired an American citizen nanny to take care of him. The American ABA provider also gets thousands of dollars each year for providing services to my son. So, indirectly this rule is also very beneficial for American citizens.REPORT COMMENTS

In my opinion it should not be stopped. For those who have not idea about this. H4 Ead is given to those whose spouse cleared I140 stage in GC processing. Next stage is i485 (EAD). So, in next few years anyways both will get EAD and they are eligible for work.so it is not bad idea to give just 1 2 years before, More over, employees are not fools to take candidate who are not experienced or uses fake resume. They will ask each and every details and do all sort of background verification. They will hire a candidate who has talent , not on criteria of Visa or nationalism. I know people who are much talented and converted from H1 to H4 EAD to get full times. I know people who started business on H4 EAD and hiring Americans as well. Every H4 person who enters this country knows that they are not eligible to work till they get their 485, so i dont think it is a great idea to change the rule and put American workers in disadvantage. Yes stricter scrutiny is needed in every aspect of immigration because even genuine people suffer due to fakes but doing away with this would be cruel and not in line with the values of equality and freedom our great nation stands for. H4 EAD is a very bad decision by Obama administration. At the State Of Michigan there are lot of Indian IT contractors who have been working there for ages without Green cards. Now their spouses got H4-EAD and taken full time positions at the state. Most of them are never worked in IT before and also some of them are having non IT related degrees. I believe through background verification needs to be carried out to avoid these loopholes. I myself have a double masters, a prior experience of 5 plus years in HR field and waited for around 3 years to get this EAD after completing a Masters degree. I work as a Full Time employee now after undergoing a strenuous interview process. This EAD is just not an authorization to work but also allowing freedom to work according to their capacity, fulfilling their dreams and establishing their careers. I am in favor of a meticulous verification too but just scrapping the EAD would not serve any purpose. I have completed my masters from US and have years of experience .Yet I patiently waited for 10 years for my I140 to be cleared and the H4 EAD rule to be passed. If I wanted to fake my resume I could have done that years ago and got a H1B and become an IT tester in any software company but I did not . Every individual who live legally in this country should be allowed to work and earn a living. Also, there are people with H4-EAD and works in HR, health care, education, etc ( Non-IT and non STEM). what about them? Why should they suffer from what is a happening in IT industries? I wholeheartedly agree. The H-1B grants companies an opportunity to solve the problem of jobs that require skilled expertise that isn't available among Americans. The cost of shouldering a dependent is to be borne by the compensation provided to the skilled H-1B employee. If the H4 dependent has marketable skills in demand by the industry, they should clearly seek H-1B valid employment. Granting an EAD to an H4 is unfair to Americans as it is not held to the same criterion as H-1B, and redundant to the H-1B. Lastly, immigration is a privilege, not a right. I am an H-1B holder myself, and I embarrassed by the gross misuse of the H-1 visa system. Unfortunately green card dates are current for every country except India. This leaves them vulnerable to abuse by employer sponsoring the job or green card for long time. People who benefit form H4EAD are spouses waiting for green card for several years ranging from 10-15 yrs or more in some cases. I do not understand the logic of giving green card lottery or even family sponsored green cards who may not even pay any tax or be dependent on the system for benefits. Provide green cards to families who will not be dependent on the system and pay taxes, have the ability to create wealth, jobs. Take the off the cap on green cards given to single country. If you are so good, ask your freaking employer to apply for your H1 or GC, if your employer are not applying or if you cannot find a company that is willing to sponsor your H1, you are just simply not that good. There are over 200k applicants every year, which means there are 200 thousand people who can find an employer who are willing to sponsor their H1-B. If you cannot even make it to the 200,000 every year, you are NOT THAT GOOD and you are taking jobs away from American.
