You invite someone to come and work for you Advance your technology your industry and tell them that you cannot have a family life because we will not allow your spouse to work. someone with the same credentials coming from Mexico or Canada can get a GC in few months and their spouses can work but someone from India with similar credentials if not better should have to wait 20 years. As Beverly said the H4 EAD was just a patch work to help the broken immigration system. Now it's the target ....

Its absolutely fine to get rid of foreign workers completely if US does not need them. Surely the immigration law was set for the betterment of US based on its own need. Or do you think the US lawmakers aren't smart enough? Nobody asked for this law to be set, other than the US lawmakers themselves. If the people are entering US in accordance with this law, why should they suffer? Laws need to be revised from time to time. What stopped the lawmakers from making common sense improvements to the law? Why invite immigrants first and then make them bear the brunt of your hatred and xenophobia. Better not have sent out the invitations for decades.

    Why is the rant only about H4 EAD? The people who are eligible to get H4 EAD are already in the GC queue for over 6 years. It only because they are from India, China or Philippines that they need the H4 EAD, otherwise they would already have been GC holders like the people from other countries, therefore not requiring the H4 EAD. Then why not repeal the work authorization for GC or GC EAD as well? Why should any talent based immigration system care about the country of origin of a person; should it not be based on just "talent"? Which other country has a country of origin based quota for talent based immigration? All other developed countries have a point/score system for talent based immigration. The issue is about people having partial knowledge about the immigration policies. There would not have been a need for H4 EAD if the immigration policy was not broken in the first place. H4 EAD is a temporary patch. Once the immigration policy is fixed right, there wouldn't be a need for H4 EAD as only the talented individuals would be eligible to be in the GC queue thereby eliminating the huge waits (15-20 years in present times) that talented people go through to obtain the GC.

More so, criteria like completing a STEM degree from the US and also having had the experience of working in the US before should also be given importance to. The individual may have to switch to H$ because of family reasons, but the long wait for GC that people from countries like China & India have to go through is ridiculous. So, instead of revoking the H4 EAD program, more stringent criteria should be implemented.

    While there are genuine cases of H4 EAD holders, 90% of them are fake. This was a insane rule passed by previous administration resulting in dead cheap low quality high tech work force. It should be revoked to preserve the jobs for really qualified people. I don't understand why the people on H1B which is a guest worker program constantly complain about rights and fair treatment. They are getting treated fairly by giving them an opportunity to get GC eventually. If they do not have patience, they can find a country which will give them in 2 months.

L2 dependent visa s have work permit from the very first day they get into the country no one has a problem with that but if H4 spouses get EAD after clearing i140 I don't understand why is it so much of a problem. Faking resumes are not restricted to any particular visa .

    I see many cases where the house wife with zero experience gets an EAD and takes some trainings. Then enter into the STEM jobs with fake experience. There are many employers who supply these EAD candidates with Fake experience to the Vendors. In some cases, i see that the husband working in one company pulls his wife to the same company using all his influence.

    The only way to stop this misuse of EAD or any Visa is not to revoke them. It can be done by blocking the companies/employers which has no direct client. They just supply the candidates with all fake experience to the vendors only to get the 20% or 30% from their actual billing. This has be stopped.

    If EAD is being misused, the solution to that is fixing the misuse, not revoking the EAD. Revoking the EAD will severely damage those who 'do not misuse' it. Also, there are a lot of people legally misusing the H1B visa program, filing based on fake job offers. For that do you recommend cancelling H1B as well ?

    I agree that H4EAD got missued in some cases but it really useful for many spouses in legal and good ways. It can be categorized on the basis of education level and to increase the level of background check. Please do not stop H4 EAD, as the case like me even need that. I am working on H1B with direct employers here and its been 5 years.My current employer never had done GC process before the reason they are not doing it for me. So in that case the only way for me continue working is H4EAD. Please do not stop H4EAD.

    This is totally wrong! What you are referring is not H4EAD issue, it is the problem with employers and background check process. It won't go away with just revoking H4EAD. The same employers do inflated resume for h1, residents and citizens. The flaw is in background check enforcement system. Just because you find some under age drivers or DUI cases you would want to stop giving out driver's licenses!! You need to strengthen you law enforcement and punishment to deter people not to misuse the privileges. Don't make the genuine ones suffer. Also you need to understand that H4EAD is given to spouses who are otherwise qualified and almost approved for PR but waiting in line for AOS due to the completely broken and dysfunctional immigration system.

    I strongly oppose this petition. I have a PhD in Electrical and Computer Engineering from a US university. My wife has a MS degree in Computational Engineering from a US university. After her graduation, she took a break from pursuing her career, because of child birth. She had to convert to H4 from F1 because of the break. Now, the only way she and other STEM degree holders like her can make significant contribution to the society is by getting an EAD on H4.

    Please do not revoke H4 EAD. I hold a degree in STEM (and work in the field of statistical modeling) and my prospective employer ran a battery of background tests which I cleared successfully. You may install a vetting process to keep the fake resumes out, but please do not just revoke the rule altogether and keep ambitious people like me away from work.

    I agree that H4 EAD needs scrutiny but taking it away is going to hurt STEM people with genuine experience and no other means to stay in the work force. I went on H4 EAD after 2 terms of H1B because I did not want to burden my mid-sized employer with an expensive Green Card process when my spouse had already applied for GC years earlier. Both of us have grad degrees from a good U.S university, more than a decade of experience each, and have been waiting for the GC priority date to become current for 7 years, and i'm now getting a second grad degree and trying to start my own business. Taking away H4 EAD will set us back at least 5 years, and I will risk losing valuable time and skills mid-career. Please make the process more stringent but allow high-skilled workers to continue to contribute to the American economy. Shut down body-shopping businesses and Asian tech giants that exploit EB1 and L1/L2 visas, before you deprive high-skilled workers with U.S degrees and many years of domestic experience of our employment and weaken our ties to this glorious country that we have come to call home.     I have completed my finance degree from a reputed college in US also I have my CFA( chartered financial analyst). I have just started working for a finance firm on my H4 EAD. The firm I work for did a thorough background check. So I can say that all H4 EAD do it fake work experience . I have heard of many instances where people with H1b and L1 and L2 have faked their work experiences. So I just don't understand why H4 EAD is a target. H4 EADs are given only to people with cleared i140 which means they will have their green cards soon. So why make them wait. Yes I agree that there should be audits not only for H4 EAD s but also for all H4 people who apply and get their H1b with false work experiences

Even in my new job, I got a background check done on me. So I don't think this fake resume news is true.Whoever is getting hired always goes through background checks. Since I came to US on H4, I was not able to work all these years. But still I did voluntary work for an employer for 2 years and got employed by this same employer soon after I got my H4 EAD. It helped me a lot. My employer is aware of my exp and degree and I'm paid according to that. I should have like 3 +2 years equals five years, but only getting paid like a entry level position. What do you have to say?

    I came to US on H4 and got an H1 to start working many years back. What exactly is it that H4 EADs are cribbing about ? If I understand correctly these are the not so professional ones , not capable of competing for H1 and now want to work in US by faking the resume. I personally know of many such cases that had not even bothered to apply for H1 earlier and are now working because of EAD. Dont you think H4 EADs are depriving a more deserving candidate of their job ? Audit all H4 EADs and most of them will be found to be working with fake experience.

    I understand what you say citizen. You say that H1b spouses should not work because they got married to someone who has h1b. I can apply and get H1 b or I wait for the next 15 years to get my GC. Do you know that H1 b is mostly given to IT professionals. So if the spouse of the H1 b worker is not from the IT field they shouldnot work. In short H1b workers shouldnot have a family as they should know that their family will not be allowed to work in their prime years.

    (Suvanee), I read some of your posts. I can understand your frustration. H4 EAD is a temporary work permit approved in the time of Obama. It can be revoked anytime based on certain circumstances. H4's are dependent no matter what and that's what their status is till they get a GC. If dependent H1 gets cancelled H4 is cancelled as well. I really did not understand when you mentioned about cruelty. when you come to US along with your H1 spouse, "was working in US was your intention", if yes then you should have applied for H1 or L1. You came in a different status, now you are fighting for rights which is not applicable to you based on US protocol.

    H4 EAD's should go and the real H1B's should get job. There are families where the primary H1B person does not even have a job. Most of the QA jobs and BA jobs are taken easily by H4 EAD's. The main point here is why do you need double income. For more money people apply H1B and come to US, then still greedy 'want more money' even if the primary works. Anyhow the economic condition of the country will be good, if H4 EAD's go, then eventually those jobs will be occupied by someone else. I heard people say "I am giving to the country" that's .......500% false. THE ECONOMIC CONDITION OF THE COUNTRY WILL BE EVEN GOOD IF THIS HAPPENS and more H1B's will give opportunity and more H1B's can come.

If an employer/recruiter cannot identify talented persons, isn't them the reason for all issues highlighted in this petition? Even if H4 EAD rule is scraped, people with fake resumes need to wait only for few more years by which they'd get green card and apply for a job with fake resume again! What would you do then? Stop given Green card? By scraping H4 EAD rule, you'd be harming more people with genuine career including my wife who's working as a Language translator (entry level job).

So, instead of targeting a small group of people, most of whom would be having a genuine career, tech industry should look at identifying the ineligible candidates. How can you punish people with genuine career for some atrocities committed by a few (which again is not restricted to H4 EAD!)? Doesn't make sense at all..

    H4 EAD is completely justified .People need to get their facts checked.h4 EADs are given only to people who have cleared I140 for their Green card processing,That means they are on their way to become citizens of this country.There is no point depriving these people of their right to work for valuable years and then allowing them to work when they are old have lost all their skills.The Green card process can take upto 15 years for some countries.     Yeah it is not fair removing H4 Ead. Its not about working in IT. What about the people invested in the buisness and doing other Jobs. If that is the case, you might have not supported this when they implemented this process during Rule making. Its not a Game to put when ever they need remove when ever they want..If thats the case if you do a better back ground check and in person face to face Interviews with senior level people that is good enough rather do trouble every one.
